To elect a Chairman of the Staffing and Appeals Committee for the duration of this meeting.

Resolved that Councillor A.C. Harman be elected Chairman of the Committee for the duration of the meeting.

Exempt Business

To move the exclusion of the Press and Public for the following item in view of the likely disclosure of exempt information within the meaning of Part 1 of Schedule 12A to the Local Government Act 1972, as amended by the Local Government (Access to Information) Act 1985 and by the Local Government (Access to Information) (Variation) Order 2006.

Resolved to move the exclusion of the Press and Public for the following item in view of the likely disclosure of exempt information within the meaning of Part 1 of Schedule 12A to the Local Government Act 1972, as amended by the Local Government (Access to Information) Act 1985 and by the Local Government (Access to information) (Variation) Order 2006.

Appeal by employee against dismissal

To consider the appeal in accordance with the hearing procedure that follows.

 

Reason for exemption:

This report contains exempt information within the meaning of Part 1 of Schedule 12A to the Local Government Act 1972, as amended by the Local Government (Access to Information) Act 1985 and by the Local Government (Access to Information) (Variation) Order 2006:

 

Paragraph 1 - information relating to an individual.

In all the circumstances of the case, the public interest in maintaining the exemption outweighs the public interest in disclosing the information because:

the information in the report is personal data about an employee of the Council and publication could not be justified under the Data Protection Act 2018.

The Chairman introduced members and officers present and welcomed everyone to the appeal hearing.

 

The appellant was introduced and the Chairman then explained the procedure to be followed at the hearing.

 

The hearing continued in accordance with the procedure.

 

The reason for the appeal and response to the appeal was heard and all parties were given the opportunity to ask and respond to questions.

 

Having heard the evidence presented, the Committee retired to consider and determine the appeal.

 

Upon reconvening, the Chairman gave the Committee’s decision. He confirmed that the decision would be communicated in writing.

 

Resolved that the appeal is upheld.
