Minutes:

The Committee considered a report setting out necessary amendments to the Constitution to bring the Constitution in line with the Renters Rights Act 2025 and the Town and Country Planning Act (Discharge of Local Planning Authority Functions) (England) Regulations 2026. The Monitoring Officer advised the amendments related to the Renters Rights Act had previously been covered under a general delegation, and were being updated with specific references. The amendments related to the Town and Country Planning Act introduced a new national scheme of delegation which made significant changes to the way planning applications were determined.

The Monitoring Officer and Planning Development Manager advised a guide would be provided for internal use to assist with demonstrating how applications may be referred to committee.

The Committee resolved to recommend that the Council agree the required amendments to the following parts of the Constitution: Part 3(b) (Terms of Reference – Planning Committee), Part 3(d) (Delegation to Officers), and Part 5(d) (Planning Code).
