This decision will be taken under urgency procedures.

Reason for urgency:
The Council is currently 8 years into a 10 year contract for the provision of grounds maintenance services in its parks & open spaces. In May 2017 the contractor and Spelthorne Borough Council agreed a mutual termination of the contract. The date the contract is anticipated to end is 18 July 2017. All machinery currently used on the Spelthorne contract is owned and/or controlled by the current contractor Lotus and they will be removing this at contract end. It is therefore not possible to defer the decision until the expiry of 28 working days for the publication of notices under the regulations, as this would not be sufficient time in which to procure and take delivery of the equipment required to manage the service as an in-house operation with effect from 19 July 2017.

Explanation of anticipated restriction:
This report contains exempt information within the meaning of Part 1 of Schedule 12A to the Local Government Act 1972, as amended by the Local Government (Access to Information) Act 1985 and by the Local Government (Access to information) (Variation) Order 2006 Paragraph 3 – Information relating to the financial or business affairs of any particular person (including the authority holding that information) and in all the circumstances of the case, the public interest in maintaining the exemption outweighs the public interest in disclosing the information because (a) the report contains details of a proposed procurement, and to publish details of the Council’s intentions in advance would prejudice a best value deal for the Council and (b) the report contains confidential details of a negotiated settlement with our supplier and publication of the details of this settlement would prejudice the ability of the Council to conclude this negotiation on the best terms possible.

This report contains exempt information within the meaning of paragraph 3 of Schedule 12A of the Local Government Act 1972, as amended by the Local Government (Access to Information) Act 1985 and by the Local Government (Access to information) (Variation) Order 2006): Information relating to the financial or business affairs of any particular person (including the authority holding that information) and in all the circumstances of the case, the public interest in maintaining the exemption outweighs the public interest in disclosing the information because, disclosure to the public would prejudice the financial position of the authority in the bidding process for the site by allowing other bidders to know the position of the Council. This in turn prejudices the Council by (i) distorting the bids process and (ii) prejudicing the opportunity for the Council to acquire a site through the Council for the prudent management of its financial affairs.
